Terms of Service

These Terms of Service govern your use of the Optimum Data Solutions website at https://optimumdata.solutions (the "Site"). Optimum Data Solutions ("ODS," "we," "us," or "our") is an independent Salesforce consultancy. This page is written in plain English because legal terms you can't read aren't terms you can rely on.

By using the Site, you agree to what follows. If you don't agree, that's fine, but please don't use the Site.

Acceptance of These Terms

These Terms are an agreement between you and ODS. By accessing or using the Site, reading our content, submitting a form, or otherwise interacting with the Site, you confirm that you have read these Terms and agree to be bound by them.

If you are using the Site on behalf of a company or other organization, you confirm that you have the authority to accept these Terms on its behalf.

If you do not agree with any part of these Terms, your option is straightforward: do not use the Site.

What This Site Is

The Site is a marketing and information resource. It exists to explain who we are, describe the kinds of Salesforce and AI work we do, share articles and guides, and give you ways to get in touch.

Everything published here, including service descriptions, blog posts, guides, case studies, calculators, and any examples or estimates, is provided for general informational purposes. It is not professional, legal, financial, or technical advice tailored to your specific situation, and it is not an offer to enter into a contract.

Your particular Salesforce environment, data, goals, and constraints are unique. Nothing on the Site should be treated as a recommendation for your specific circumstances until we've actually discussed them with you.

Consulting Engagements Are Separate

This is the part most website terms bury, so we'll put it up front: the Site is not the contract for our services.

Any consulting, implementation, advisory, or other professional work ODS performs is governed by a separate written agreement, such as a statement of work (SOW), proposal, or services agreement signed by both parties. That separate agreement controls the scope, deliverables, fees, timelines, warranties, confidentiality, data handling, and responsibilities for the engagement.

Browsing the Site, downloading a guide, using a calculator, or submitting a contact form does not create a consulting engagement, a client relationship, or any obligation on our part to perform work. If anything in these Terms conflicts with a signed services agreement between you and ODS, the signed services agreement governs for that engagement.

Intellectual Property and Use of Content

Unless noted otherwise, the content on the Site, including text, articles, graphics, logos, layouts, code, and the "Optimum Data Solutions" name and branding, is owned by ODS or its licensors and is protected by intellectual property laws.

You may view, read, and share our content for your own personal or internal business use, including linking to our pages and quoting short excerpts with attribution. That's the point of publishing it.

You may not, without our prior written permission:

  • Copy, republish, or redistribute substantial portions of our content as your own
  • Use our content for commercial resale or in a competing offering
  • Remove or alter copyright, trademark, or attribution notices
  • Use our name, logo, or branding in a way that implies endorsement or partnership that doesn't exist

Salesforce, Agentforce, Data Cloud, and other third-party names and marks referenced on the Site belong to their respective owners. ODS is an independent consultancy and is not Salesforce, Inc.; references to those products are for description only and do not imply affiliation or sponsorship unless we say so explicitly.

Acceptable Use

When using the Site, you agree not to:

  • Use it for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems
  • Interfere with or disrupt the Site, including through malware, scraping that burdens our infrastructure, or denial-of-service activity
  • Submit false information through our forms, or use them to send spam or harmful content

We may suspend or restrict access to the Site for anyone who misuses it.

Third-Party Links

The Site may link to third-party websites, tools, scheduling services, or resources for your convenience. Examples include scheduling links, social profiles, and references in our articles.

We don't control those third-party sites and we're not responsible for their content, accuracy, products, services, or privacy practices. A link is not an endorsement, and we make no promises about anything you find on the other end of one.

When you follow a link off the Site, you do so at your own risk and the terms and privacy policies of that third party apply, not ours.

No Guaranteed Results

We are deliberately careful about what we claim, and these Terms reflect that.

Any outcomes, metrics, timeframes, savings, ranges, or examples mentioned anywhere on the Site, including in articles, case studies, and calculators, are illustrative. They describe what has been possible in specific situations or what a tool estimates based on inputs you provide. They are not promises, guarantees, or predictions of the results you will achieve.

Salesforce outcomes depend on factors specific to your business, including the state of your data, your processes, your team, your licensing, and decisions you make along the way, many of which are outside our control. Calculators and estimates on the Site are simplified models for planning conversations, not financial advice or assurances of return. Where ODS commits to specific deliverables or outcomes, that commitment will appear in a signed services agreement, not on this Site.

No Warranty

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, ODS disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We work to keep the Site accurate and available, but we don't warrant that it will be error-free, current, uninterrupted, secure, or free of harmful components. Content may become outdated as Salesforce products and the broader landscape change, and we are under no obligation to update it.

Limitation of Liability

To the fullest extent permitted by law, ODS and its founder, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of, or inability to use, the Site or its content, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Site is limited to one hundred U.S. dollars (US $100).

This section addresses use of the Site only. Liability for any paid consulting engagement is addressed in the separate written agreement that governs that engagement.

Some jurisdictions do not allow certain limitations or exclusions of liability, so some of the above may not apply to you. In that case, our liability is limited to the smallest extent permitted by law.

Governing Law

ODS is based in and operates from the United States. These Terms and any dispute arising from your use of the Site are governed by the laws of the United States and of the state in which ODS maintains its principal place of business, without regard to conflict-of-laws rules. The specific governing state and venue for the consultancy will be confirmed in writing the State of Utah.

Where a signed services agreement exists between you and ODS, the governing law and dispute-resolution terms in that agreement control for the engagement it covers.

You agree to resolve any dispute relating to the Site in the courts located in that jurisdiction, to the extent permitted by applicable law.

Changes to These Terms

We may update these Terms from time to time, for example, to reflect changes to the Site, our services, or the law.

When we do, we'll revise the "Last updated" date at the top of this page. Material changes take effect when posted, and your continued use of the Site after that means you accept the updated Terms.

We won't apply changes retroactively to disadvantage you for use that already happened, and we don't change the terms of any signed services agreement by editing this page.
